The Royal Government

 

          -          Having seen the constitution of the Kingdom of Cambodia

          -          Having seen the Royal Decree No: NS/RKT/0908/1055 dated September 25, 2008 on the appointment of the Royal    

                     Government of the Kingdom of Cambodia.

          -          Having seen the Royal Kram No: 02/NS/94 dated July 20, 1994, promulgating the law on the organization and

                     functioning of the Council of Ministers.

          -          Having seen the Royal Kram No: NS/RKM/0196/15 dated January 24, 1996, promulgating the law on the establishment

                     of the Ministry of Tourism.

          -          Having seen the Royal Kram No: NS/RKM/1207/032 dated December 08, 2007, promulgating the law on education.

          -          Having seen the Royal Kram No: NS/RKM/0609/007 dated June 10, 2009, promulgating the law on Tourism.

          -          Having seen the Sub-Decree No: 34/ARNKR.BK dated August 05, 1997 on the organization and functioning of the

                     Ministry of Tourism.

          -          Having seen the Sub-Decree No: 65 ARNKR.BK dated April 29, 2005 on the establishment of the National Training

                     Board.

          -          Having received the approval from the Council of Ministers at the plenary session on December 24, 2010.

 

HEREBY DECIDE

Chapter 1

General Provisions


Article 1:

                To establish a National Committee for Tourism Professionals with an abbreviation of “N.C.T.P” to facilitate the mobility of tourism professionals in the ASEAN member states and to encourage the exchange and best practice in a bid to build up a capacity of tourism professionals in the Kingdom of Cambodia and in other ASEAN member states.

 

Chapter 2

Composition

 

Article 2:

            The N.C.T.P is composed of:

1-Minister of Tourism   Chairman

2-Secretary of State of the Ministry of Labor and

    and Vocational Training

3-Secretary of State of the Ministry of Education,

   Youth and Sport
01 Member

4-Secretary of State of the Ministry of Culture and

   and Finance

   of Ministers
01 Member

7-Representative of the Ministry of Interior,

   National Police Department
01 Member

8-Representative of the National Training

9-Representative of the Accreditation Committee

of Cambodia

10-A Number of Representatives of Tourism Industry

The exact composition of the N.C.T.P shall be defined by the Royal Government’s decision.

 

Chapter 3

Roles and Duties

 

Article 3:

            The N.C.T.P has the following roles and duties:

            -Raising awareness and disseminating information related to the mutual recognition arrangement of ASEAN tourism professionals and the job announcement on the ASEAN tourism professional registration system.

            -Examining, monitoring and updating the competency standard, professional standard, common training programs and other regulations which will be basically used for training and assessing the qualification and capacity of ASEAN tourism professionals in compliance with tourism professions commonly recognized within the framework of ASEAN which is the Sub-Decree’s appendix.

-Assessing the qualification and competency of tourism professionals as defined in the ASEAN’s common competency standard for tourism professionals, and the ASEAN’s common curriculum for tourism professionals.

-Examining and monitoring tourism professionals’ performances after receiving tourism professional competency certification from the National Training Board.

-Facilitating the information exchange related to the procedures of assessing criteria and disseminating system on the mutual recognition arrangement of ASEAN tourism professionals.

            -Giving information to the ASEAN’s monitoring committee for tourism professionals; in case the ASEAN’s tourism professionals performing their careers in the Kingdom of Cambodia have no more qualifications for providing their services or in case the tourism professionals broke the professionally technical standards or the professional conduct.

-Making a request to the National Training Board to confiscate the accreditation from any tourism professionals having no longer qualifications for providing their services or any tourism professionals breaking the professionally technical standards or the professional conduct.

-Setting up and strengthening working efficiency and the necessary mechanism to facilitate the implementation of the mutual recognition arrangement of the ASEAN’s tourism professionals.

-Cooperating with Ministries, institutions, the private sector and relevant stakeholders to facilitate the above works more efficiently.

            -Performing other works as assigned by the Royal Government.

 

Chapter 4

Functioning of N.C.T.P

 

Article 4:

            The N.C.T.P shall hold the meeting following the chairman’s invitation.

 

Article 5:

            The N.C.T.P shall be able to invite the representatives of the relevant ministries-institutions, professional officials, specialists or the private sector to join the counseling meeting and discussion, additionally to carry out researches about the issues related to its framework.

 

Article 6:

            Formalities and procedures of the N.C.T.P shall be set up by the internal regulations of the N.C.T.P.

 

Article 7:

            The N.C.T.P shall be able to set up a number of professional taskforces as necessary to ensure its working process’s efficiency. The roles and duties of each taskforce shall be defined by the decision of the N.C.T.P’s chairman. 

 

Article 8:

            The N.C.T.P shall be able to accept the number of technical advisors and national/international specialists as necessary.

 

Article 9:

            The N.C.T.P shall consist of a Secretariat in the Ministry of Tourism as its wing.

            The organization and functioning of the Secretariat of the N.C.T.P shall be defined by the Prakas of the Minister of Tourism as the N.C.T.P’s chairman.

 

Article 10:

            The N.C.T.P shall be subject to use the Ministry of Tourism’s seals for its daily working performances.

 

Chapter 5

Sources of Budget Resources

 

Article 11:

            The N.C.T.P shall contain a separate package of supplying budget sources which is an appendix of the Ministry of Tourism’s budget, and funds from development partners’ financing sources as well as other legal sources for efficiently fulfilling its working performances.

 

Chapter 6

Final Provisions

 

Article 12:

            Any provisions contrary to this Sub-Decree shall be null and void.

 

Article 13:

            The Minister in Charge of the Office of the Council of Ministers, Minister of Economy and Finance, Minister of Tourism, Minister of Labor and Vocational Training, Minister of Education, Youth and Sport, Minister of Culture and Fine Arts, the Ministers, Secretaries of State of all relevant Ministries-Institutions shall be responsible for implementing the Sub-Decree starting from the date of the signature onwards.
